Terms of Sales
Last updated: March 2026. These Terms of Sales govern all paid access to the Apptimize service provided by YFOUNDERS. By subscribing to a paid plan, you accept these terms in full.

2. Scope and Application
These Terms of Sales define the conditions under which YFOUNDERS provides paid access to the Apptimize platform (the "Service") via app.tryapptimize.com.
They apply to any individual or legal entity (the "User" or "Customer") subscribing to a paid plan, whether acting as a business (B2B) or as a private individual (B2C — Consumer). Certain rights — notably the right of withdrawal and access to consumer mediation — apply exclusively to consumers as defined under the French Consumer Code.
Placing an order constitutes full and unconditional acceptance of these Terms of Sales, the Privacy Policy, and any specific conditions displayed at checkout.
3. Service Description
Apptimize is a SaaS platform for Apple App Store Optimisation (ASO), accessible from a web browser with no installation required. The Service includes:
- Analytics dashboard: overview of app performance (impressions, installs, revenue).
- Metadata editor: bulk management of titles, subtitles, keywords and descriptions across all localisations, with direct push to App Store Connect.
- ASO AI analysis: automated AI-powered audit of metadata quality and marketing screenshot effectiveness.
- A/B tests (Custom Product Pages): creation, management and comparison of Apple custom product pages.
- Keyword research: global keyword research tool with search volume, difficulty scores, and top competing apps.
- Apple Search Ads: campaign management, keyword bidding, and performance reporting.
Some features (push to App Store Connect, Search Ads management) require the User to provide their own Apple API keys. These keys remain the User's property and can be revoked at any time from App Store Connect.
4. Licence of Use
For the duration of the active subscription, YFOUNDERS grants the User a personal, non-exclusive, non-transferable and revocable licence to use the Service.
The following are expressly prohibited:
- Reselling, sub-licensing or sharing access to the Service with unauthorised third parties.
- Scraping, crawling or automatically extracting platform data or functionality through circumvention methods.
- Bypassing API call limits or rate-limiting mechanisms.
- Using the Service for illegal, fraudulent or unlawful purposes.
- Attempting to access other users' data or non-exposed infrastructure components.
5. Plans and Pricing
The Service is offered as a monthly or annual subscription. Full details of plans and their prices (VAT inclusive for EU residents) are displayed on the pricing page and at checkout before any order is confirmed.
For European Union residents, French VAT at the applicable rate is included in the displayed price. The VAT amount is itemised on the invoice.
YFOUNDERS reserves the right to modify pricing. Any price change will be notified to the User by email with at least 30 calendar days' notice before taking effect. Users who do not accept the new pricing may cancel their subscription before the effective date of the change.
6. Billing and Payment
Payment is processed exclusively online via Stripe, a certified payment service provider. YFOUNDERS does not store full card numbers on its servers.
Billing occurs at the start of each subscription period (monthly or annually). Invoices are available in the customer billing portal (Stripe Customer Portal) and sent by email. All invoices include YFOUNDERS' EU VAT number (FR31900145327).
In the event of a failed payment, YFOUNDERS reserves the right to suspend access to the Service after notifying the User, until the situation is resolved.
7. Renewal and Cancellation
Subscriptions renew automatically at the end of each period (monthly or annual) unless cancelled by the User beforehand.
The User may cancel their subscription at any time, without fees or penalties, directly from the Stripe Customer Portal accessible via account settings. Cancellation takes effect at the end of the current billing period, and access to the Service is maintained until that date.
No pro-rata refund is granted for unused portions of the current period, unless required by applicable law or expressly agreed by YFOUNDERS. Cancellation of an annual subscription mid-term does not entitle the User to a refund of remaining months.
YFOUNDERS reserves the right to terminate or suspend an account in the event of a breach of these Terms of Sales, without prejudice to any claim for damages.
8. Right of Withdrawal (Consumers)
Under Articles L221-18 et seq. of the French Consumer Code, Users acting as consumers (private individuals outside of any professional activity) have the right to withdraw from their subscription within 14 calendar days of the subscription date, without stating a reason or incurring any penalty.
Waiver of the right of withdrawal: pursuant to Article L221-28 9° of the French Consumer Code, if the User expressly requests immediate access to the Service at the time of subscription (before the 14-day period expires), the User acknowledges and agrees that the right of withdrawal is lost once performance of the Service has commenced. This waiver is collected during the checkout process.

9. Intellectual Property
The Apptimize platform (source code, interface, design, trademarks, logos, algorithms, documentation) is the exclusive property of YFOUNDERS and is protected by French intellectual property law and international copyright law.
User data — including the User's app metadata, provided API keys, and reports generated from the User's data — remains the exclusive property of the User. YFOUNDERS makes no ownership claim over this data and will not use it for its own commercial purposes.
The User grants YFOUNDERS the right to use their data in aggregated, anonymised form solely for the purpose of improving the performance and features of the Service.
10. Third-Party Dependencies
Some Apptimize features rely on third-party APIs and services whose availability is outside YFOUNDERS' control, including:
- Apple App Store Connect API: metadata submission, version management.
- Apple Search Ads API: advertising campaign management.
- iTunes Search API: public app search.
- OpenAI / OpenRouter: AI analysis of metadata and screenshots.
YFOUNDERS shall not be held liable for interruptions, modifications or discontinuation of these third-party services by their respective operators. In the event of a prolonged outage materially affecting a paid feature, YFOUNDERS will notify affected Users and explore available alternatives.
11. Service Availability
YFOUNDERS commits to making every effort to maintain Service availability of 99% on a monthly basis, excluding planned maintenance. Planned maintenance will be notified with at least 24 hours' notice by email or via an in-app information banner.
This availability target is an obligation of means, not of result, and excludes incidents related to third-party infrastructure (Supabase, Vercel, Cloudflare) or Apple APIs. In the event of a major unplanned outage, YFOUNDERS will communicate the service status and estimated restoration times.
12. Limitation of Liability
To the fullest extent permitted by French law and in accordance with Article 1231-3 of the French Civil Code, YFOUNDERS' liability under these Terms is limited as follows:
- Cap: YFOUNDERS' total liability, for any and all causes, is capped at the total amounts actually paid by the User in the 12 months preceding the event giving rise to the claim.
- Exclusions: YFOUNDERS shall not be liable for indirect, consequential, incidental or special damages, including but not limited to: loss of revenue, loss of data, lost ASO opportunities, App Store ranking loss, commercial loss or reputational damage.
- ASO outcomes: recommendations generated by the Service (AI analysis, keyword suggestions, etc.) are provided for informational purposes only. YFOUNDERS does not guarantee any specific results in terms of App Store ranking, visibility or installs.
These limitations do not apply in cases of gross negligence or wilful misconduct by YFOUNDERS, nor to mandatory legal rights of consumers.
13. Force Majeure
In accordance with Article 1218 of the French Civil Code, YFOUNDERS shall not be held liable for failure or delay in performing its obligations due to a force majeure event — that is, an unforeseeable, irresistible and external event — including:
- Outages or interruptions of third-party cloud infrastructure (Supabase, Vercel, AWS, Cloudflare).
- Interruptions or modifications to Apple APIs (App Store Connect, Search Ads).
- Cyberattacks, large-scale DDoS attacks or major security incidents.
- Natural disasters, strikes, armed conflicts or governmental decisions.
In the event of a force majeure event, YFOUNDERS will inform the User as soon as practicable and make every effort to restore the Service as quickly as possible.
14. Consumer Mediation
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, YFOUNDERS offers consumers, after exhausting internal dispute resolution channels, the right to refer the matter to a certified consumer mediator free of charge.
If a dispute has not been resolved within 60 days of a written complaint sent to hello@tryapptimize.com, the consumer User may contact the competent mediator. The mediator's contact details are available upon request at the address above.
The European Commission also provides an Online Dispute Resolution (ODR) platform for consumers in the EU, accessible at: ec.europa.eu/consumers/odr.
15. Governing Law and Jurisdiction
These Terms of Sales are governed by French law. Any dispute relating to their interpretation, validity or performance shall be submitted to the competent courts as follows:
- B2B (business customers): any dispute shall be brought before the Commercial Court of Montpellier (Tribunal de Commerce de Montpellier), to which the parties grant exclusive jurisdiction.
- B2C (consumers): mandatory territorial jurisdiction rules under the French Consumer Code and Code of Civil Procedure apply. The consumer retains the right to bring proceedings before the court of their place of residence.
For international disputes, the Rome I Regulation (EC No 593/2008) on the law applicable to contractual obligations and the Brussels I bis Regulation (EU No 1215/2012) on jurisdiction shall apply.
